Norwegians do not hijack airplanes, they do however, get arrested for it! I was down at the airport to see my mother on the plane back to Norway. This was the year before we paid lip service to the constitution. May it rest in peace, as it certainly did in my case! Are jokes dangerous? I didn't think so either, but apparently the (Denver) police is of a different opinion, and since the police is not an hazard, it must be the jokes. A baggage clerk was a little slow in grasping that only my mother was going. The clerk asked for luggage. Only my mother turned in luggage. The clerk asked for tickets. Only my mother handed in a ticket. The clerk asked how many were going. I told her that only my mother was going, and my mother said something to the same effect. In spite of having received only one set of luggage, and one ticket, and having heard both of us tell her that only my mother was going, the clerk still managed to ask: "Is only one of you going?" Whereupon I, rather than getting annoyed, quipped: "I am not coming along, I am only here to hijack the plane." In hindsight, I might have been better off by getting annoyed. I didn't repeat my punch line at the airport. I did, however, claim that we have freedom of speech in this country, but where is the A.C.L.U. (the American Civil Liberties Union) when you need them? The first clerk tracked down and explained the situation to a second clerk who then told me: "It is dangerous to make such jokes at the airport these days." I responded: "Wait a minute, this is a free country, we have freedom of speech here, I am a member of the Libertarian party and have a track record of standing up for liberty." Upon hearing I was a Libertarian, the airline clerk responded that he would call in the FBI and run me through the system. I guess he thought they could always find something to charge a Libertarian with. The report shows that to improve his odds, he falsely accused me of having repeated my hijacking joke another 2 times to him as well. And to top it off, they used my affiliation with the Libertarian party, to accuse me of being a member of a liberation organization! Luckily I didn't repeat my witty remark, or they might have charged me with being a repeat offender, brought out the racketeering act and confiscated my arsenal of jokes before I could have got(ten) to my third punch line. It came close though, because to back up the second clerk, the first clerk who was the only airline clerk to hear me use the word hijack, later conspired with her coworker and falsely claimed in writing that I somehow had repeated my punch line 3 times, to her as well, before the second clerk was called in. Apparently the airline has a manual that requires that its employees at least claim to have given 3 warnings before they can arrest you for your statements. Actually giving any warning though, doesn't seem to be necessary, as long as the employee is willing to lie about it. The police didn't lack a sense of humor. They took as a joke every right that I invoked. In order to get some respect for rights that the police were denying me, I invoked in writing, the right to sue them. That, they did not take as a joke! The police response to my written call for redress was swift and effective: They immediately confiscated my papers and pencils. Is honesty, truth and justice so dangerous that you have to confiscate even the paper and pencils of your victims? The police come across a lot of dirty tricks in their job and they used about every one of these to intimidate me and to prevent me from getting released or near a phone or lawyer until they could fabricate enough allegations to derail my call for redress. By the time the police investigation was complete my one witty spur of the moment hijacking remark had turned into sworn police testimony that I somehow had threatened to hijack a plane more than 20 times. One officer told me quote: "The case has now gone too far, we can't let you go, that would be to admit a false arrest." He also added that: "Now you probably think that we are hijacking you." To which I responded that I would be glad to quote him on that. A sheriff's deputy told me that I had no rights, and that he would like to make me run, so that he could shoot me in the back. Was it really necessary for the jail guards in the middle of the night, to drag me feet first, across a whole prison floor, dump me in an escalator, throw a blanket over me, call me one dead duck, and take me down in the basement, where one of the more violent sheriff deputies, already had threatened to shoot me the day before? Couldn't justice have been served without such police misconduct? The inmates were great. Most of the trouble makers I came across, worked for the airline or the police! Public communications used to carry signs saying "No blacks!" If they now carry signs saying "No jokes!", then it is the same problem, and the problem is not with blacks and jokes! We are all used to searches, delays and lost luggage. Is service the only joke permitted at the airport? Most of us know someone named Jack. Sooner or later you might run into him at the airport. If you were to greet him with "Hi Jack!", would they call out the swat team? For a while the false arrest had a chilling effect on my desire to exercise my first amendment rights: When my mother flew in as a witness in the case, she and a few others didn't get all their luggage back, in spite of some of them having seen it being put on the plane at the latter's last stop over. The situation got a little tense and under normal circumstances I would have quipped: "Do we have to hijack this plane to get our luggage back?" In stead I thought of apologizing to the airline for the inconvenience our luggage was causing them and for not having sent it by train. The first lawyer I got hold of could hardly have done a worse job if he had worked for the airline, the police and the prosecution. My first lawyer finally withdrew from the case when I insisted upon my right to defend myself. How can justice prevail when one is not even permitted to speak out in one's own defense? Amazing how when liberty is outlawed, jokes are treated seriously and liberty is treated as a joke. It took 14 days in jail, 2 prosecutors, 3 judges and referees, 7 lawyers, 9 months, 10 court appearances and close to 14,000 dollars in legal fees, before I finally won the legal case that was falsely brought against me. At least I can't complain that no one takes my jokes seriously! How many Norwegians does it take to hijack an airplane? Norwegians do not hijack airplanes, they do however, sue for redress! In May of 1987 I counter sued the perpetrators. Six years later my counter suit was still in court. As it turned out, justice is not as speedy a process, as injustice. Do we have equality under the law in this country? When our president can joke about starting a nuclear war, shouldn't the rest of us at least be permitted to shout "Fire!" The problem (in this country) is not with freedom of speech, but with lack of freedom after speech! A threat is not in the eye of the beholder! A joke about hijacking has as much to do with hijacking as dandelions have to do with lions! A joke is a joke and to treat it as a crime, is a crime! Poor is any nation that lacks the liberty and legal integrity to differentiate between wit and threats. If I can't even get respect for my jokes, how can I expect to get respect for my more serious political concepts? To the extent the law permits the police transgressions that I was run through, to that extent the law is part of the problem for which redress should be offered, and until such redress is offered it will be pursued. Airport security seems to value safety above liberty, in the process doing away with both. It is time the (United) airlines learn that independent of how high they fly, they are still not above the law! This legal battle has cost me more than 30,000 dollars so far just in legal fees, and still counting. No one is going to tell me that liberty comes cheap on this side of the Atlantic. My redress case got railroaded and was never set for trial. In the United States these days, crimes against the foreign born and railroading of victims are the rules, and trial by jury is the exception. Redress for just grievances was not offered in court, but I still retain the right to retry the culprits in a more rights respecting court as soon as the latter can be established. I have appealed or will appeal to the supreme court and beyond, to the president, to the politicians, and if necessary to a constitutional convention, and if this nation can no longer tolerate wit, then I will dig in and replace my arsenal of jokes with much heavier ammunition, like a declaration of independence, a constitutional charter or at least a bill of rights. I am working on it. (I have one here!) And once a more rights respecting court has been established, then I will renew my motion that my redress case be set for trial, so that I finally can get a chance to police the police before the culprits all die of old age! If anyone would like to assist me, that would be nice, otherwise I regard myself as fully capable of winning redress on my own, so that being a Libertarian, won't be just another - joke! Just before my arrest, a few of us skied in to Conundrum natural hot springs by Aspen, a narrow valley with 67 known avalanche slopes, 28 or so that runs every year. Once all this litigation is over, I will organize another ski trip in to Conundrum. It will be nice to get away from the legal system and finally be back in a safer environment! I am publishing my jokes so to better finance my call for redress. When one is arrested over a joke, one might as well use jokes in one's defense. If you now are tired of my wit and just want to lock me up and throw away the key or at least deport me, just relax, they already did. But with the high cost of fighting such transgressions, let us hope that I can win redress so that I once again can afford to be silent! -- In the meantime be warned: The United States is a police state, much like those it has been propping up around the world, and as much in need of individual liberty as the latter.
