THE AMERICAN GULAG. 
Our own concentration camps, by one of the survivors.

     As of writing this I have so far (only) been arrested twice
in my life time. Both were false arrests in cases I later
unconditionally won. Each time the police searched all kind of
files to see if they could pin anything else on me. The only thing
they found was a suspicion that I might have been born in Norway,
something I don't look upon as a particular crime!
     The police tried to railroad me out of the country before I
could get redress for the false arrest. So much for protectionism
being used by government transgressors to evade their own
liabilities!
     Some of the police officers even resorted to perjurious
fabrications to justify turning me over to I.N.S., and to speed up
my deportation. I guess you can say that they went beyond the call
of duty!
     The I.N.S. placed me in a concentration camp in Aurora that
didn't quite live up to German standards. So much for those of you
who might have thought that nothing could give Aurora a worse name
any more!
     That concentration camp is now out of business and has been
replaced by a bigger and better one, if you can rate concentration
camps as being better than one another and not just all a
disgraceful shameless travesty of justice!
     In the concentration camp there were 45 Mexicans, a few
Iranians and Libyans, one Italian murderer, a Japanese and me. I
was probably the only one who opted to stay here and fight for
liberty in court, after all, I was the only one who knew the law
and still believed it could be resurrected.
     The others wanted more or less to go elsewhere and do to
Americans what Jefferson did to the English. So much for what the
I.N.S. does to make the world safe for Americans!
     While in the concentration camp for aliens I stood up and
asked: "What is the difference between an I.N.S. agent and a Nazi?"
The answer? (In 1986 it was:) 45 years! Needless to say I was not
all that popular with the guards.
     I am not the only one to spend some time in a concentration
camp in Aurora!
     Did you hear about the Polish sailors who defected to the
United States in the late nineteen eighties, only to be placed in
a private concentration camp run by a company called "Wachenhut"?
     Imagine being Polish escaping to the United States only to be
placed in a concentration camp run by a company carrying a German
(sounding) name? Their parents would have felt right at home!
     Aside from the fact that the Germans seem to have won the
peace and now are exporting their strongest traditions, is this
really something that we are proud of importing? And if so, why did
we bother beating them in the first place?!
     The bail was 100 dollars in my airport case and 1,000 dollars
in my Boulder case. Apparently the police looks upon letter
delivery as a more serious crime than hijacking jokes.
     Being Norwegian is apparently an even worse crime, for that
the bail was 2,500 dollars!
     I.N.S. judge Sellers set my bail at $3,500 later reduced to
$2,500 while most of the Mexicans got out on 500 dollar bonds, this
in spite of me at the time never having been arrested before, being
charged only with 2 misdemeanor charges with a bond of $100 in the
airport case, and having clearly expressed a willingness to appear
in court for as many times as it would take to get redress. I fail
to see how being Norwegian is so much more heinous than being
Mexican, that it should justify such a difference in bond!
     Based on the excessive bail, the I.N.S. seems to look upon
being Norwegian as a felony.
     When I paid my bail in the immigration case, someone remarked
that my bills looked like they just had been issued, so I quipped:
"Yes, I just printed them." If that had been at the airport, I
would probably have ended up another two weeks in jail.
     The I.N.S. judge claimed I had entered this country in January
of 1980. When I tried to call witnesses from South Dakota that know
otherwise, the judge ruled that South Dakota is too far away to
call witnesses from. Technicalities such as the truth, didn't seem
to concern him!
     I guess you can say: out of state, out of sight, after all
isn't that what protectionism is all about?
     On the other hand, with that kind of protectionist ruling one
start wondering  if even our own federation is safe from the
I.N.S.!
     In order to rail-road me out of the country before I could get
redress in the airport case, the police fabricated more evidence,
and as usual it back fired on them.
     The prosecutor in I.N.S. court claimed in writing (quote) that
"Subject (that is me) had been arrested by FBI (sic) after a threat
(sic) he made to an airline stewardess (sic) that he would hijack
(sic) the plane he was riding on (sic)."
     A serious accusation that didn't quite hold water: The
prosecutor was not able to pinpoint what stewardess I had
threatened, what plane I had been riding on or where and when I had
been flying and it didn't help him much that lots of witnesses know
that I hadn't been flying anywhere in the first place. Furthermore
I was not arrested by the FBI, but by the Denver police over the
objection of the FBI, who refused to prosecute me.
     This is the kind of police fabrication that makes your day,
because it is a tangible piece of evidence that one can sue them
over!
     The prosecution's fabrications didn't deter the judge, because
he ordered me deported anyway, maybe to protect the police against
the more serious threats of wit, liberty and aliens!
     I was ordered deported based on an uncertified photocopy of
an international driver's license issued in Norway. A document that
is available to anyone, does not indicate nationality and
furthermore had been illegally obtained by the police as a result
of a false arrest. But as the prosecutor indicated, anything is
acceptable as long as it serves justice!??
     The I.N.S. judge asked me what I was doing, took a short look
at some of my drawings and plans for facilities that can survive
nuclear war, said he hoped we won't need my services and then
ordered me deported.
     Judged on his behavior he doesn't seem to think we need
liberty either.
     After he had illegally ordered me deported, the judge
acknowledged, that if he had been around at the time, he would have
deported the pilgrims too.
     On the way out I asked the judge: "If you had been around at
the time would you have deported the pilgrims too?" To which he
said "Yes." I immediately responded that I would be glad to quote
him on that, whereby he blushed and corrected himself by adding
that if he had been a native American he would.
     If nothing else it made it clear that he is not a native
either.!
     It is a sobering thought that very few of us would have been
around if the native Americans had employed the equivalent of
today's I.N.S.
     Yes, I am a visaless alien, proudly so, but no one in I.N.S.
court knew that, and no one cared to prove it either, they were
just too busy trying to get me deported.
     Yes, I am Norwegian, but I hadn't admitted that yet, and no
one in I.N.S. court at the time presented any proof or acceptable
evidence to that effect, either!
     Symptomatic of the mock trial and kangaroo court that was used
to order me deported, is, the fact, that on the way out, after I
had been ordered deported to Norway, the prosecutor and one of his
co-workers, still wondered where I was from!
     On the way out from the court room after I had been ordered
deported, the prosecutor and one of his companions ran into me in
the escalator and asked me where I was from. That was after they
had ordered me deported!
     There is no doubt in my mind that I was ordered deported to
whatever country happened to be mentioned in the literature in my
pockets.
     And that if I had worn another pair of trousers the day I got
arrested, I would have been deported to Canada or Switzerland, as
long as it was out of the country!
     If I understood the judge correct the prosecutor hadn't proven
me guilty, but I had failed to prove my innocence and that was
enough to get me deported!
     I guess that is what they call summary judgment!
     So much for taking the fifth amendment when the burden of
evidence is reversed!
     As long as the I.N.S. treat their victims as guilty until
proven innocent, silence would be self-incriminating.
     If it was a crime to be visaless the I.N.S. would be in
contempt of the fifth (and sixth) amendment, so what do they do?
They call the I.N.S. prosecution a civil process, as though there
was anything civil in their wholesale abasement of due process! 
     If criminals received the same punishment as the foreign born,
deportations would soon be declared cruel and unusual punishment
and thus unconstitutional!
     In general due process is more important in criminal cases
than in civil cases, because the punishment is usually more severe
in criminal cases. The detention, inconvenience and punishment in
immigration cases, however, is more severe than the punishment in
most criminal cases, and this should justify the same high standard
of due process in immigration cases as in criminal cases. On the
other hand in I.N.S. court the purpose apparently is not to protect
the rights of the accused but to do away with all such.
     If protectionists had higher moral standards they would apply
the same high standards of due process to immigration cases as we
apply to criminal cases and grant the foreign born their right to
trial by jury, restrict to jail time the punishment for those
convicted of being illegal aliens and grant the latter citizenship
upon the completion of their sentence. On the other hand a
protectionist with high moral standards is an oxymoron. If
protectionists had higher moral standards they wouldn't be
protectionists in the first place.
     There is no doubt in my mind that any fifth generation
American journalist faking an accent and otherwise standing up for
his rights as I did, would easily be deported as well, just try it,
and your editor will love the story!
     Needless to say, I appealed the deportation order, citing
unconstitutional transgressions by the I.N.S.
     If nothing else my case has exposed how our courts have
completely debased themselves as far as immigration cases are
concerned!
     I qualified for the limited amnesty that was offered in 1986,
but I refused to ask for a pardon for being free!
     To call immigration cases slow is an under statement,
on the other hand immigration court is proof that when justice is
delayed justice is denied:
     For the first few years I thought that if the deportation case
ever got moving, I would eventually win the appeal. On the other
hand if I was to lose the appeal, the only outcome would be that
I would automatically qualify for the general amnesty that later
had been offered.
     I expected to win my immigration case and didn't want to apply
for amnesty for having unilaterally declared myself an American,
after all didn't Jefferson take pride in having done the same?
     Then the amnesty ran out, before anything had happened to the
immigration appeal. 
     However I was standing up for cherished American
principles like the right to trial by jury, freedom of contract
and equal protection under the law, I was doing valuable work,
hadn't committed any crimes, was generally seen as more American
than most, and the police and the I.N.S. had violated so many
rights that I fully expected to win the appeal. Little did I then
know that due process is no longer upheld in immigration cases, and
that all the rights that you and I take for granted have been
systematically done away with in immigration court. However, I was
to find out the hard way.
    After a few years the border patrol made it clear that it
still wanted me to create value anywhere but here!
     My response was that if worse comes to worst, I would rather
apply for political asylum elsewhere, until liberty could be
reinstituted domestically too.
     I told the Immigration and Naturalization Service that I had
no intention of leaving this country voluntarily, unless I got
political asylum in Switzerland. Maybe I should have claimed
Voltaire as a precedence, or at least let them know about my
designs for life extending research and treatment centers or
nuclear war-proof, constitutionally chartered medical research
facilities and spas.
     In the meantime the I.N.S. was holding the $2,500 that I paid
in bail. I was originally told that I was not even getting
interest, on the other hand, this way I couldn't lose the money on
the stock market. I.N.S., however, could still steal the
money.
     Usually bail is not revoked without cause as long as the
appeal process is not exhausted. In my case the local I.N.S. office
showed their utter disregard for due process by unilaterally
declaring my appeal process as exhausted and ordering me to show
up for deportation while I still had the right to appeal the latter
to the U.S. Supreme Court.
     The local I.N.S. office by its action declared the Supreme
Court irrelevant. If nothing else the latter should get a chance
to agree.
     I know from past experience that it is virtually impossible
to appeal police transgressions while detained, and denied your own
archive, computer, phone and even pen and pencil as the I.N.S has
a habit of denying its victims, and I had to become a fugitive in
order to properly prepare my appeal to the Supreme Court. 
     After two months on the run I got caught and deported.
The old concentration camp had in the meantime been replaced
by a new one that was 5 times as big. Don't tell me that
concentration camps are not a growth industry. 
     In the United states they even privatize them! 
     And in stead of 45 mexicans, there were now several hundred
Mexicans. This time I didn't get to meet them, though, because
the I.N.S. gave me preferential treatment. 
     I had my own isolation cell all to myself. And everyone who
tried to reach me was told by the I.N.S. that I didn't want to
speak to anyone. Which would have been thoughtful of the I.N.S.
except that they never bothered to ask me about it, and luckily my
friends and the press knows me and didn't believe it either. 
     Extreme meassures was taken to prevent that I got near a phone
or a lawyer in time to file a petition for a writ of habeas corpus
or for a stay of deportation, until the Supreme Court or the
population, press and politicians could put a stop to the
transgressions of the local I.N.S. director and his deputies.
     One of which made it clear to me that there was no sense in
trying to invoke Jeffersonian liberties, because the I.N.S. was not
respecting such anymore. I thought the population might want to
know, in the hope that someone will conclude that we would be
better off by deporting not me, but the I.N.S. 
     In parting I quoted world war II general Douglas McArthur:
"I shall return!" And I have spent the time since preparing 
just that. It took McArthur several years to get back, and I too
will postpone my return until I have the necessary strength to rout
the culprits and shut down the I.N.S.
     There is something wrong with our society when one gets
arrested over a joke, for letter delivery, and for being Norwegian!
     There is no question in my mind that granted respect for due
process and common law, including a trial by a jury of my peers,
I would beat the I.N.S. in court any time!
     However, jury trials are not granted by the I.N.S., instead
the judge who appears to be hired by the prosecuting agency, also
serves as the jury!
     Maybe someone should remind the I.N.S. that one of the
grievances set forth in the declaration of independence, is for the
failure to respect our right to trial by a jury of our peers?!
     If the government doesn't stand up for my rights, I might as
well do it myself!
     In the late nineteen eightees, I counter sued the I.N.S. And
the courts have so far made it clear that it is not any easier to
sue the I.N.S. today than it was to sue the Nazis in Germany in the
thirties!
     I was born free, and I fully intend to stay free.
     I am a visaless alien, proudly so! I am as visaless as the
original pilgrims, and for many of the same reasons. If this is now
a crime, then I might as well make the most of it!
     There was a time when people took pride in being undocumented
and equated that with liberty. I still do! As a result I am more
documented by government than I ever objected to be in the first
place!
     I equate liberty with being undocumented, and though I have
consistently qualified for several visas, I have since 1980
refused to apply for such. My stand is, that if you have to ask
for permission to become free you are not free in the first place
and that if you have to continuously ask for and have permission
to be free you are not really becoming free either! 
     In stead I am making it known that I am free by right, to
associate freely with others, herein to travel and trade freely at
my own cost and to contract freely with others., and that our
present immigration laws constitute an unconstitutional
socialization of the right of citizens and aliens alike to freedom
of religion, expression and association, including freedom of
travel, trade and contract. But isn't the constitution saying the
same or shouldn't it?!
     Basically, I refuse to take the time to ask for permission to
do what others have no right to deny me.
     It is below my dignity to beg for liberty, it is much more fun
to raise hell, in the best American tradition.
     Norwegians established a right of way in this country
predating the time of Columbus, and I invoke the grand father
clause for among other reasons, that I hate to surrender any right
without a battle!
     I was born in Norway, and I have never felt guilty about it!
     A week before my arrest while celebrating the Norwegian
national holiday, we were told that no ethnic group spends less
time in jail than Norwegians (or Norwegian-Americans). Maybe that
is why the police didn't know how to handle my case, they weren't
used to processing Norwegians!
     While in the U.S. I used to say that legally I am not here,
but still back in Norway.
     Actually I am stateless because the Norwegians no longer
regard me as Norwegian either. Apparently I have lived too long in
the United States! Maybe it is time to create a world citizenship.
I am working on it!
     Wouldn't it be nice with a world government dedicated to
cracking down upon local police states, like our own?
     Being Norwegian, is the only thing I have ever been convicted
of.
     And even being Norwegian I am no longer guilty of, so at least
I can't be accused of being an habitual offender!
     On the other hand, if being an habitual Norwegian sounds like
being an habitual offender, maybe you should go to work for the
border patrol? You would fit right in!
     The courts and opposing counsel do not always like my wit and
have repeatedly criticized me for displaying it, and requested that
my one-liners be destroyed or stricken from the record. but as long
as I am regarded as a born criminal, not permitted to invoke
fundamental rights, and given no choice in the matter; as long as
the legal system is making a joke out of itself, I might as well
let others in on the laugh, after all, you folks are paying for
this system so you might as well get something back!
     To anyone who regards me as a born criminal, your bigotry
leaves me no other option, but making the most of it!
     I am a world citizen who happens to have been born in Norway,
and I refuse to regard either neither as a crime nor as a civil
infraction!
     This country was founded on the idea of no taxation without
representation, and the nice thing about being a visaless alien is
that when you are not permitted to vote, it would be outright
illegal to pay taxes, unless you volunteer for it, which I don't!
     I am American, by choice, by heart and in spirit, which is
more than one can say about the I.N.S!
     I came here by choice, this used to be the best and freest
country around, and I still think I can gain respect for liberty
here, as soon as we abolish the border patrol and its use of
customs, passports, visas, green cards, work permits and
concentration camps!
     I am working on it!


(Postscript to the Americaan gulag article)

     My goal is active life extension. I can do my best in liberty
among equally free men and women. And the only way to become free
is to practice liberty, which I do. Thus I am deliberately standing
up and challenging the protectionist transgressions of the I.N.S.
     I came here on a valid visa, but soon came to the conclusion
that to use or apply for visas would be to sanction protectionism,
and that it would be wrong to do so. And though I have always
qualified for a passport and several visas, I have deliberately
abstained from renewing either.
     I qualified for the general amnesty that was offered in 1986,
but declined to apply for it.
     Since 1980 I have consistently refused to apply for or use:
passports, visas, work permits, or any related documents.
     It is disgusting how this country is treating the foreign
born, and how I.N.S. employees are harassing aliens. And it is high
time that someone stands up against and puts a stop to this
country's protectionism including our disgraceful concentration
camps.
     So let it be known: No one has a right to enforce customs or
visa-, passport- or work permit- requirements, and when you do, you
are committing a crime against humanity, for which you will soon
be held personally liable!
